Attorneys Robert J. Moriarty and Laura Fitzgerald recently prevailed in the case of Spillane v. Adams in which the Massachusetts Appeals Court adopted the position argued by Mr. Moriarty and Ms. Fitzgerald that the proper method of measuring low water mark is by reference to the NOAA National Geodetic Vertical Datum system.  In doing so the Court acknowledged that it was establishing new precedent.
